A writ petition has also been filed at the Supreme Court on November 3 this year on behalf of the IB, demanding annulment of the order for reason of its failing to meet the processes. <br /> A single bench of Supreme Court Justice Devendra Gopal Shrestha issued a mandamus to the Appellate Court on Sunday (Nov 29) to present response stating reasons for issuing the interim order.</p> <p>The judges of the Appellate Court of Patan Kumar Chudal and Durga Dutta Bhatta had served an interim order in the month of June to stay the payment of liability to the United Insurance Company and to stop the business of Agni Insurance Company pending final decision. </p> <p>The Appellate Court feels that it will be an irreparable loss not to implement the decision of the IB in the context that the insurance and re-insurance have been already done as per legal procedures and the insurance money has been already paid on the basis of evaluation of insurer and re-insurer. The appeal pleads for the payment of entire liability by taking bank guarantee or any other reliable security from the insured against the additional disputed amount if the later demands the payment of insurance money.</p> <p>CG Electronics of Chaudhari Group had caught fire on October 14, 2012. The IB had decided to stop the payment of insurance and had imposed partial restriction on the company’s business saying that the insurance transactions on the loss caused by fire were against law. In the on-the-spot observation report, the IB has said that action was taken for failing to observe even ordinary rules to be followed on the rate of fire insurance and for failing to inform about the insurance transactions carried out with the management. The company had provided waiver on the insurance fees illegally for installing fire control system. The report of the survey, however, shows that upon inquiry it was discovered that no fire control system was ever installed and that the fire was extinguished with the use of fire brigade. </p> <p> Based on the unsatisfactory clarification of the chief of the department of risk assessment and payment of claim, the IB has been stating that the order to stop fire insurance business of Agni Insurance and the fine imposed on the concerned employees is legal. The IB, however, is defending itself saying that to hold repeated hearings even after the details of on-the-spot observation, insurance policy report and the clarification of the company on the payment of claim is against natural law. </p> <p>The company is saying that floater insurance, declared insurance and the insurance of buildings and machineries while insuring the property of Chaudhari Group which is also a founder shareholder of Insurance Company. But the Committee has concluded that the insured amount of equipment have not been quoted, Insurance fees have not been adjusted, proposal forms were not properly filled and insurance was done on credit by accepting risk without receiving insurance fees. The company has made it clear that it has directed to refund the paid insurance amount from the Chaudhari Group saying that it is against basic arrangement of insurance and also against law to get more payment than the cost of the actual stock of insured objects. </p> <p>The appeal says that the action of the court to order the payment of the insurance claim treading in areas where its responsibility is not established, is out of its jurisdiction and erroneous. The IB has been a systematic and advanced regulatory agency of the insurance business. It has the authority to register the insurer, renew policies, stop insurance business in course of regulation, order payment claim, carry out observation and supervision as well as take action. He had started a helicopter service in Nepal in 2055 BS with the brand name of Shree Airlines Pvt. with a view to provide air services to remote areas.</p> <p>Established as the largest airlines company in the country, the helicopters of Shree Airlines are still providing air services to remote Himalayan and hilly districts of Nepal. It has also successfully provided air services for various UN peace missions and the UN World Food Programme. Mittal had started the service with a fleet of five helicopters. </p> <p>Mittal was born to a business house at Watu Tole in Kathmandu in 1992 BS. His was a family which had earned the reputation of being one of the 32 Kothi Mahajans (thirty two eminent business households). Initially, he had started his career with a clothes store known as Hanumandas Clothes Store traditionally run by his father. After coming back from his studies, he set up B.L. Mittal and Mittal and Construction Company in 2015 BS. Through this company, he accomplished the construction of the Kathmadu-Janakpur Road, Nepalgunj-Surkhet Road and a number of irrigation projects. As democracy was at an initial stage, he started an import business through Mittal and Company in 2023 BS. He left this business in 2054. He also imported garments from China and Korea through his Sugan Garment Company. He also established North Nepal Tea Estate Company. He took a dealership of the National Trading Company in 2021 B.S. and participated in the World Trade Expo held in Japan in 2027 B.S. by setting up a company stall.</p> <p>Soft spoken and transparent, he liked good business practices and encouraged others to do the same. He believed that only the wealth earned through one’s sweat and hard labour would last and that anything that is earned through deception would not give spiritual happiness. He also considered it a great act of piety to spend part of the profit in social service. He unswervingly followed the path of integrity throughout his life. The swelling crowd of mourners who had reached Aryaghat for his funeral vindicated this. </p> <p>His contribution to the country’s chamber movement is memorable. Mittal, who held the position of a member of the central working committee of the Nepal Chambers of Commerce was also a founding chairperson of Nepal Construction Entrepreneurs’ Association. He was one of the founders of the Confederation of Nepalese Industries and was former chairperson of Marwadi Sewa Samiti. He had held positions like acting treasurer of the Pashupati Area Development Trust, was a founding member of Nepal Eye Hospital and founding treasurer of Nepal Netrajyoti Sangh. Founder of Alok Bidyashram, he was also the founding director of the South Asian Institute of Management. Adviser to the Nepal National Marwadi Council, he was affiliated with many religious, business and social institutions. Mittal, who also dedicated his thoughts to Nepal’s politics, was considered an intellect of the business community. He belonged to the few people who have carried out serious study of Vedic religion and culture. </p> <p>He was a business person but stood out from the crowd. He often said, “I wanted to know about the way of life of the hill people. I noticed that people in the hills have a compulsion to trek for four hours only to fetch drinking water. After that I took the contract for building the Kathmandu-Trisuli Highway.” He visited Japan and Australia five decades ago to learn the ropes of business. He said that he learnt the art of business from the association he had with the business persons of these countries. </p> <p>Always proud of serving the nation through business, he was decorated with the Suprabal Gorkha Dakshinbahu Third, Coronation Medal, Birendra-Aishwarya Medal and many other national honours. A writ petition has also been filed at the Supreme Court on November 3 this year on behalf of the IB, demanding annulment of the order for reason of its failing to meet the processes. <br /> A single bench of Supreme Court Justice Devendra Gopal Shrestha issued a mandamus to the Appellate Court on Sunday (Nov 29) to present response stating reasons for issuing the interim order.</p> <p>The judges of the Appellate Court of Patan Kumar Chudal and Durga Dutta Bhatta had served an interim order in the month of June to stay the payment of liability to the United Insurance Company and to stop the business of Agni Insurance Company pending final decision. </p> <p>The Appellate Court feels that it will be an irreparable loss not to implement the decision of the IB in the context that the insurance and re-insurance have been already done as per legal procedures and the insurance money has been already paid on the basis of evaluation of insurer and re-insurer. The appeal pleads for the payment of entire liability by taking bank guarantee or any other reliable security from the insured against the additional disputed amount if the later demands the payment of insurance money.</p> <p>CG Electronics of Chaudhari Group had caught fire on October 14, 2012. The IB had decided to stop the payment of insurance and had imposed partial restriction on the company’s business saying that the insurance transactions on the loss caused by fire were against law. In the on-the-spot observation report, the IB has said that action was taken for failing to observe even ordinary rules to be followed on the rate of fire insurance and for failing to inform about the insurance transactions carried out with the management. The company had provided waiver on the insurance fees illegally for installing fire control system. The report of the survey, however, shows that upon inquiry it was discovered that no fire control system was ever installed and that the fire was extinguished with the use of fire brigade. </p> <p> Based on the unsatisfactory clarification of the chief of the department of risk assessment and payment of claim, the IB has been stating that the order to stop fire insurance business of Agni Insurance and the fine imposed on the concerned employees is legal. The IB, however, is defending itself saying that to hold repeated hearings even after the details of on-the-spot observation, insurance policy report and the clarification of the company on the payment of claim is against natural law. </p> <p>The company is saying that floater insurance, declared insurance and the insurance of buildings and machineries while insuring the property of Chaudhari Group which is also a founder shareholder of Insurance Company. But the Committee has concluded that the insured amount of equipment have not been quoted, Insurance fees have not been adjusted, proposal forms were not properly filled and insurance was done on credit by accepting risk without receiving insurance fees. The company has made it clear that it has directed to refund the paid insurance amount from the Chaudhari Group saying that it is against basic arrangement of insurance and also against law to get more payment than the cost of the actual stock of insured objects. </p> <p>The appeal says that the action of the court to order the payment of the insurance claim treading in areas where its responsibility is not established, is out of its jurisdiction and erroneous. The IB has been a systematic and advanced regulatory agency of the insurance business. It has the authority to register the insurer, renew policies, stop insurance business in course of regulation, order payment claim, carry out observation and supervision as well as take action. Through this company, he accomplished the construction of the Kathmadu-Janakpur Road, Nepalgunj-Surkhet Road and a number of irrigation projects. As democracy was at an initial stage, he started an import business through Mittal and Company in 2023 BS. He left this business in 2054. He also imported garments from China and Korea through his Sugan Garment Company. He also established North Nepal Tea Estate Company. He took a dealership of the National Trading Company in 2021 B.S. and participated in the World Trade Expo held in Japan in 2027 B.S. by setting up a company stall.</p> <p>Soft spoken and transparent, he liked good business practices and encouraged others to do the same. He believed that only the wealth earned through one’s sweat and hard labour would last and that anything that is earned through deception would not give spiritual happiness. He also considered it a great act of piety to spend part of the profit in social service. He unswervingly followed the path of integrity throughout his life. The swelling crowd of mourners who had reached Aryaghat for his funeral vindicated this. </p> <p>His contribution to the country’s chamber movement is memorable. Mittal, who held the position of a member of the central working committee of the Nepal Chambers of Commerce was also a founding chairperson of Nepal Construction Entrepreneurs’ Association. He was one of the founders of the Confederation of Nepalese Industries and was former chairperson of Marwadi Sewa Samiti. He had held positions like acting treasurer of the Pashupati Area Development Trust, was a founding member of Nepal Eye Hospital and founding treasurer of Nepal Netrajyoti Sangh. Founder of Alok Bidyashram, he was also the founding director of the South Asian Institute of Management. Adviser to the Nepal National Marwadi Council, he was affiliated with many religious, business and social institutions. Mittal, who also dedicated his thoughts to Nepal’s politics, was considered an intellect of the business community. He belonged to the few people who have carried out serious study of Vedic religion and culture. </p> <p>He was a business person but stood out from the crowd. He often said, “I wanted to know about the way of life of the hill people. I noticed that people in the hills have a compulsion to trek for four hours only to fetch drinking water. After that I took the contract for building the Kathmandu-Trisuli Highway.” He visited Japan and Australia five decades ago to learn the ropes of business. He said that he learnt the art of business from the association he had with the business persons of these countries. </p> <p>Always proud of serving the nation through business, he was decorated with the Suprabal Gorkha Dakshinbahu Third, Coronation Medal, Birendra-Aishwarya Medal and many other national honours. A writ petition has also been filed at the Supreme Court on November 3 this year on behalf of the IB, demanding annulment of the order for reason of its failing to meet the processes. <br /> A single bench of Supreme Court Justice Devendra Gopal Shrestha issued a mandamus to the Appellate Court on Sunday (Nov 29) to present response stating reasons for issuing the interim order.</p> <p>The judges of the Appellate Court of Patan Kumar Chudal and Durga Dutta Bhatta had served an interim order in the month of June to stay the payment of liability to the United Insurance Company and to stop the business of Agni Insurance Company pending final decision. </p> <p>The Appellate Court feels that it will be an irreparable loss not to implement the decision of the IB in the context that the insurance and re-insurance have been already done as per legal procedures and the insurance money has been already paid on the basis of evaluation of insurer and re-insurer. The appeal pleads for the payment of entire liability by taking bank guarantee or any other reliable security from the insured against the additional disputed amount if the later demands the payment of insurance money.</p> <p>CG Electronics of Chaudhari Group had caught fire on October 14, 2012. The IB had decided to stop the payment of insurance and had imposed partial restriction on the company’s business saying that the insurance transactions on the loss caused by fire were against law. In the on-the-spot observation report, the IB has said that action was taken for failing to observe even ordinary rules to be followed on the rate of fire insurance and for failing to inform about the insurance transactions carried out with the management. The company had provided waiver on the insurance fees illegally for installing fire control system. The report of the survey, however, shows that upon inquiry it was discovered that no fire control system was ever installed and that the fire was extinguished with the use of fire brigade. </p> <p> Based on the unsatisfactory clarification of the chief of the department of risk assessment and payment of claim, the IB has been stating that the order to stop fire insurance business of Agni Insurance and the fine imposed on the concerned employees is legal. The IB, however, is defending itself saying that to hold repeated hearings even after the details of on-the-spot observation, insurance policy report and the clarification of the company on the payment of claim is against natural law. </p> <p>The company is saying that floater insurance, declared insurance and the insurance of buildings and machineries while insuring the property of Chaudhari Group which is also a founder shareholder of Insurance Company. But the Committee has concluded that the insured amount of equipment have not been quoted, Insurance fees have not been adjusted, proposal forms were not properly filled and insurance was done on credit by accepting risk without receiving insurance fees. The company has made it clear that it has directed to refund the paid insurance amount from the Chaudhari Group saying that it is against basic arrangement of insurance and also against law to get more payment than the cost of the actual stock of insured objects. </p> <p>The appeal says that the action of the court to order the payment of the insurance claim treading in areas where its responsibility is not established, is out of its jurisdiction and erroneous. The IB has been a systematic and advanced regulatory agency of the insurance business. It has the authority to register the insurer, renew policies, stop insurance business in course of regulation, order payment claim, carry out observation and supervision as well as take action. He had started a helicopter service in Nepal in 2055 BS with the brand name of Shree Airlines Pvt. with a view to provide air services to remote areas.</p> <p>Established as the largest airlines company in the country, the helicopters of Shree Airlines are still providing air services to remote Himalayan and hilly districts of Nepal. It has also successfully provided air services for various UN peace missions and the UN World Food Programme. Mittal had started the service with a fleet of five helicopters. </p> <p>Mittal was born to a business house at Watu Tole in Kathmandu in 1992 BS. His was a family which had earned the reputation of being one of the 32 Kothi Mahajans (thirty two eminent business households). Initially, he had started his career with a clothes store known as Hanumandas Clothes Store traditionally run by his father. After coming back from his studies, he set up B.L. Mittal and Mittal and Construction Company in 2015 BS. Through this company, he accomplished the construction of the Kathmadu-Janakpur Road, Nepalgunj-Surkhet Road and a number of irrigation projects. As democracy was at an initial stage, he started an import business through Mittal and Company in 2023 BS. He left this business in 2054. He also imported garments from China and Korea through his Sugan Garment Company. He also established North Nepal Tea Estate Company. He took a dealership of the National Trading Company in 2021 B.S. and participated in the World Trade Expo held in Japan in 2027 B.S. by setting up a company stall.</p> <p>Soft spoken and transparent, he liked good business practices and encouraged others to do the same. He believed that only the wealth earned through one’s sweat and hard labour would last and that anything that is earned through deception would not give spiritual happiness. He also considered it a great act of piety to spend part of the profit in social service. He unswervingly followed the path of integrity throughout his life. The swelling crowd of mourners who had reached Aryaghat for his funeral vindicated this. </p> <p>His contribution to the country’s chamber movement is memorable. Mittal, who held the position of a member of the central working committee of the Nepal Chambers of Commerce was also a founding chairperson of Nepal Construction Entrepreneurs’ Association. He was one of the founders of the Confederation of Nepalese Industries and was former chairperson of Marwadi Sewa Samiti. He had held positions like acting treasurer of the Pashupati Area Development Trust, was a founding member of Nepal Eye Hospital and founding treasurer of Nepal Netrajyoti Sangh. Founder of Alok Bidyashram, he was also the founding director of the South Asian Institute of Management. Adviser to the Nepal National Marwadi Council, he was affiliated with many religious, business and social institutions. Mittal, who also dedicated his thoughts to Nepal’s politics, was considered an intellect of the business community. He belonged to the few people who have carried out serious study of Vedic religion and culture. </p> <p>He was a business person but stood out from the crowd. He often said, “I wanted to know about the way of life of the hill people. I noticed that people in the hills have a compulsion to trek for four hours only to fetch drinking water. After that I took the contract for building the Kathmandu-Trisuli Highway.” He visited Japan and Australia five decades ago to learn the ropes of business. He said that he learnt the art of business from the association he had with the business persons of these countries. </p> <p>Always proud of serving the nation through business, he was decorated with the Suprabal Gorkha Dakshinbahu Third, Coronation Medal, Birendra-Aishwarya Medal and many other national honours. A writ petition has also been filed at the Supreme Court on November 3 this year on behalf of the IB, demanding annulment of the order for reason of its failing to meet the processes. <br /> A single bench of Supreme Court Justice Devendra Gopal Shrestha issued a mandamus to the Appellate Court on Sunday (Nov 29) to present response stating reasons for issuing the interim order.</p> <p>The judges of the Appellate Court of Patan Kumar Chudal and Durga Dutta Bhatta had served an interim order in the month of June to stay the payment of liability to the United Insurance Company and to stop the business of Agni Insurance Company pending final decision. </p> <p>The Appellate Court feels that it will be an irreparable loss not to implement the decision of the IB in the context that the insurance and re-insurance have been already done as per legal procedures and the insurance money has been already paid on the basis of evaluation of insurer and re-insurer. The appeal pleads for the payment of entire liability by taking bank guarantee or any other reliable security from the insured against the additional disputed amount if the later demands the payment of insurance money.</p> <p>CG Electronics of Chaudhari Group had caught fire on October 14, 2012. The IB had decided to stop the payment of insurance and had imposed partial restriction on the company’s business saying that the insurance transactions on the loss caused by fire were against law. In the on-the-spot observation report, the IB has said that action was taken for failing to observe even ordinary rules to be followed on the rate of fire insurance and for failing to inform about the insurance transactions carried out with the management. The company had provided waiver on the insurance fees illegally for installing fire control system. The report of the survey, however, shows that upon inquiry it was discovered that no fire control system was ever installed and that the fire was extinguished with the use of fire brigade. </p> <p> Based on the unsatisfactory clarification of the chief of the department of risk assessment and payment of claim, the IB has been stating that the order to stop fire insurance business of Agni Insurance and the fine imposed on the concerned employees is legal. The IB, however, is defending itself saying that to hold repeated hearings even after the details of on-the-spot observation, insurance policy report and the clarification of the company on the payment of claim is against natural law. </p> <p>The company is saying that floater insurance, declared insurance and the insurance of buildings and machineries while insuring the property of Chaudhari Group which is also a founder shareholder of Insurance Company. But the Committee has concluded that the insured amount of equipment have not been quoted, Insurance fees have not been adjusted, proposal forms were not properly filled and insurance was done on credit by accepting risk without receiving insurance fees. His was a family which had earned the reputation of being one of the 32 Kothi Mahajans (thirty two eminent business households). Initially, he had started his career with a clothes store known as Hanumandas Clothes Store traditionally run by his father. After coming back from his studies, he set up B.L. Mittal and Mittal and Construction Company in 2015 BS. Through this company, he accomplished the construction of the Kathmadu-Janakpur Road, Nepalgunj-Surkhet Road and a number of irrigation projects. As democracy was at an initial stage, he started an import business through Mittal and Company in 2023 BS. He left this business in 2054. He also imported garments from China and Korea through his Sugan Garment Company. He also established North Nepal Tea Estate Company. He took a dealership of the National Trading Company in 2021 B.S. and participated in the World Trade Expo held in Japan in 2027 B.S. by setting up a company stall.</p> <p>Soft spoken and transparent, he liked good business practices and encouraged others to do the same. He believed that only the wealth earned through one’s sweat and hard labour would last and that anything that is earned through deception would not give spiritual happiness. He also considered it a great act of piety to spend part of the profit in social service. He unswervingly followed the path of integrity throughout his life. The swelling crowd of mourners who had reached Aryaghat for his funeral vindicated this. </p> <p>His contribution to the country’s chamber movement is memorable. Mittal, who held the position of a member of the central working committee of the Nepal Chambers of Commerce was also a founding chairperson of Nepal Construction Entrepreneurs’ Association. He was one of the founders of the Confederation of Nepalese Industries and was former chairperson of Marwadi Sewa Samiti. He had held positions like acting treasurer of the Pashupati Area Development Trust, was a founding member of Nepal Eye Hospital and founding treasurer of Nepal Netrajyoti Sangh. Founder of Alok Bidyashram, he was also the founding director of the South Asian Institute of Management. Adviser to the Nepal National Marwadi Council, he was affiliated with many religious, business and social institutions. Mittal, who also dedicated his thoughts to Nepal’s politics, was considered an intellect of the business community. He belonged to the few people who have carried out serious study of Vedic religion and culture. </p> <p>He was a business person but stood out from the crowd. He often said, “I wanted to know about the way of life of the hill people. I noticed that people in the hills have a compulsion to trek for four hours only to fetch drinking water. After that I took the contract for building the Kathmandu-Trisuli Highway.” He visited Japan and Australia five decades ago to learn the ropes of business. He said that he learnt the art of business from the association he had with the business persons of these countries. </p> <p>Always proud of serving the nation through business, he was decorated with the Suprabal Gorkha Dakshinbahu Third, Coronation Medal, Birendra-Aishwarya Medal and many other national honours.
