Advocate Ram Chandra Poudel has filed a writ petition at the Supreme Court (SC) against the provision of barring individuals with criminal background from contesting the upcoming Constituent Assembly elections. The petitioner has argued that it will allow some of convicted people while bar others from contesting the election. According to the act, those who have been handed down final sentences by the courts for involvement in certain criminal cases including corruption, rape, murder, passport misuse, money laundering, drug smuggling and human trafficking, or have been black-listed for loan default, cannot file candidacy. The petitioner has demanded implementation of only those provisions which are accommodated in the Interim Constitution. The President and his office, Chairman of the Interim Election Council Khil Raj Regmi and his office, Election Commission and Ministry of Law and Justice have been named as defendants in the petition.
